Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Selik Customer App, the SelikRider App, and this website (collectively, the "Services"), operated by Netverse Technologies ("Netverse Technologies", "we", "us"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. See also our Privacy Policy, which explains how we handle your data.
1. The service
Selik connects customers who need something picked up and delivered with independent riders who fulfil those deliveries. Netverse Technologies provides the technology platform, including the apps, matching, routing, live tracking, and payment processing, that makes this possible. We are a technology provider, not a courier, logistics, or transportation company.
2. Eligibility
- You must be at least 18 years old to use the Services.
- You must provide accurate, current information when creating an account, and keep it up to date.
- You are responsible for all activity that happens under your account, and for keeping your password confidential.
- We may refuse, suspend, or terminate an account that provides false information or violates these Terms.
3. Additional terms for riders
If you register as a rider on the Selik Rider App, the following also applies:
- Independent contractor status: riders are independent contractors, not employees, agents, or partners of Netverse Technologies. You choose when and whether to accept delivery requests. Nothing in these Terms creates an employment relationship.
- Verification (KYC): before accepting deliveries, you must complete identity and vehicle verification, including a valid National ID or Passport, a Driving License appropriate for your vehicle class, a Certificate of Good Conduct, and proof of your delivery vehicle (and, where applicable, its logbook, insurance, and road license). You must keep this documentation valid and up to date, and promptly update us before any of it expires.
- Compliance: you must hold all licenses, permits, and insurance required by Kenyan law to operate your vehicle and carry goods for hire, and must comply with all applicable traffic and road safety laws while fulfilling deliveries.
- Conduct: you must handle packages with care, complete accepted deliveries in good faith, and treat customers professionally. We may suspend or deactivate a rider account for safety violations, fraud, repeated cancellations, or conduct that harms customers or the platform.
- Earnings: fares, any applicable platform fee, and payout terms are shown in the Rider App and may be updated from time to time with notice.
4. Fares, fees, and payment
Delivery fares are calculated based on factors such as distance, vehicle type, package details, and demand (including peak-hour pricing), and are shown to you for confirmation before you place a request. Payments are processed via Safaricom M-Pesa or other payment methods offered in the app. You authorise us to charge or collect the fare, and any applicable fees, through your chosen payment method.
5. Cancellations
You may cancel a delivery request from the app. Depending on how far the request has progressed (for example, if a rider has already been dispatched or has arrived at the pickup point), a cancellation fee may apply: this is shown in the app before you confirm the cancellation. We may also cancel or reassign a delivery, for example if no rider is available or a safety concern arises.
6. Prohibited items and conduct
You may not request delivery of, and riders may refuse to carry, any item that is:
- Illegal under Kenyan law, including illicit drugs and counterfeit goods.
- Firearms, ammunition, explosives, or other weapons.
- Hazardous, flammable, corrosive, or toxic materials.
- Live animals, human remains, or bodily fluids/tissue.
- Large amounts of cash, bullion, or unset precious stones/metals, unless the Service explicitly supports this.
- Anything that misrepresents the package's true contents, weight, or value.
You are responsible for accurately describing what you send and for ensuring it is lawful to transport. We and our riders may refuse or terminate a delivery that appears to violate this section. You also agree not to use the Services to harass, defraud, or endanger another user, or to interfere with the platform's normal operation.
7. Package liability and disclaimers
We and our riders take reasonable care with every delivery, but the Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Kenyan law:
- We do not guarantee uninterrupted, error-free, or always-on-time service (for example, due to traffic, weather, or circumstances outside our control).
- Our liability for loss or damage to a package is limited to the declared value of the package (where declared) or a reasonable amount as determined by us, and excludes indirect, incidental, or consequential losses.
- We are not liable for delays or failures caused by incorrect addresses, unavailable recipients, prohibited items, or events beyond our reasonable control.
Nothing in these Terms limits liability that cannot be limited under Kenyan law, including liability for death, personal injury, or fraud caused by our negligence.
8. Indemnification
You agree to indemnify and hold Netverse Technologies harmless from any claim, loss, or damage (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.
9. Intellectual property
The Selik apps, website, logos, and content are owned by Netverse Technologies or its licensors and are protected by intellectual property law. You may not copy, modify, or distribute them without our written permission, beyond normal use of the Services.
10. Third-party services
The Services rely on third-party providers, including Google Firebase, Google Maps Platform, Google Sign-In, Sign in with Apple, Facebook Login, and Safaricom M-Pesa. Your use of features built on these providers is also subject to their own terms and policies.
11. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or unsafe conduct, or where required by law.
12. Changes to these terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide notice through the app or website. Continuing to use the Services after a change takes effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or the Services shall first be addressed through good-faith negotiation with our support team, and failing resolution, shall be subject to the exclusive jurisdiction of the courts of Kenya.
